Our Proclamation

WHAT MUST CHANGE

Governance & Oversight

We believe the Attorney General’s Office of the State of South Carolina should be the agency that has complete oversight and governance over enforcing Non-Profit and HOA laws.

State & Federal Laws

We believe HOA rules or actions must not conflict with State, Federal or Constitutional laws.
We believe HOAs cannot discriminate against their HOA members as stated in the Fair Housing Act.
We believe the HOA should follow public parking rules as enforced by the City, County or State and not enforce their own violation rules for public parking spaces.

HOA Governing Documents

We believe HOA rules must exist for the betterment of the community.
We believe HOAs should provide clear, specific, detailed, and descriptive governing documents to avoid misinterpretations and inconsistent rulings on governing documents.
We believe vague HOA rules are not enforceable.
We believe HOA rules should be reasonable and fair.
We believe HOAs should be consistent in the way they manage their CCRs and Bylaws and carry them out in an unbiased manner whereby all HOA members are treated equally.
We believe if an HOA applies a rule to one Homeowner but not to another equally, then that rule is deemed unenforceable.
We believe all HOA records should be available electronically.
We believe the HOA should provide its membership with an effective date of CCRs and Bylaws changes well in advance of them being activated so the membership has an opportunity to understand them and ask clarifying questions beforehand.

Adherence to HOA Bylaws & CCRs

We believe HOAs, Developers, and HOA Property Management Companies should have to adhere to the HOA governing documents and if not, there are penalty consequences for not doing so.
We believe HOAs must meet all procedural requirements and apply governing rules consistently and if not, there are penalty consequences.
We believe HOA Board Members and the HOA Property Manager should be held personally accountable if they abuse their privileges or enact unfair, unenforceable HOA rules.
We believe HOA Board Members and the HOA Property Manager should be held personally accountable for enabling or performing malfeasance and theft of HOA funds.
We demand HOAs maintain all common areas as specified in the HOA governing documents and if not, there are penalty consequences for not doing so.
We believe the HOA membership voting process must be conducted in accordance with the CCRs and Bylaws.
We believe the HOA, its Board Members, and the HOA Property Management Company should be held accountable if the voting process is not carried out fairly as outlined in the CCRs and Bylaws.

HOA Records & Access

We believe HOA members should have total transparency as to how membership dues are being spent and have access to ALL HOA documents to ensure good business practices are being followed.
We believe HOA members should have access to all of the HOA Board of Directors records to ensure good business practices are being followed.
We believe there should be penalty consequences if an HOA does not provide complete accounting transparency to its membership as defined in the CCR and Bylaws.
We believe HOA members should be able to call for a forensic audit of the HOA at any time if 20% of its membership calls for one.
We believe HOAs and HOA Property Management Companies should provide timely responses to HOA member questions, inquiries, and requests.
We believe HOAs should share with its membership what vendors are being considered for community maintenance and allow members to view vendor estimates and agreement contracts.

HOA Board Members

We believe all HOA Board member names, addresses, and contact information should be provided to the HOA membership and posted to the HOA website.
We believe HOA Board Members should attend HOA meetings to help address HOA members concerns.
We believe HOA members should be able to talk directly to the HOA Board Members.
We believe the HOA Board should obtain 3 vendor estimates for community maintenance and make decisions based on vendor estimate merits and NOT based on family or close friend relationships.
We believe HOA Board Members should not increase HOA fees without reasonable, factual justification.

Architectural Review Board

We believe HOAs must maintain the aesthetics of the community and if not, there should be penalty consequences.
We believe HOA Board and Architectural Board members should be held personally accountable for bad decision making that negatively impacts the community’s reputation, appearance, or marketability.
We believe Homeowners should be able to perform regular home maintenance that doesn't change the architecture from its original state without having to submit an Architectural Review Board application and fee.

Liens & Foreclosures

We believe the State of South Carolina should regulate the foreclosure process for HOAs.
We believe HOAs must exhaust all possible remediation options before having the ability to foreclose on a home for outstanding HOA dues, fees owed or for outstanding special assessments.
We believe HOA members should have the right to negotiate payment plans so that they can afford to satisfy past due payments owed to the HOA.
We believe HOAs should work with their HOA members before foreclosure by performing a foreclosure avoidance assessment.
We believe HOAs should give their HOA members a grace period to pay past due HOA dues, fees, or special assessments if the member can prove that they are facing temporary hardship due to job loss, medical bills, or other special circumstances.
We believe if the HOA's member home is foreclosed on that any sales proceeds over and above liens owed should be paid to the former Homeowner.

Violations

We demand HOAs allow its members an opportunity to have a hearing if there is a disagreement as to a violation.
We believe HOAs and HOA Property Management Companies must present proper evidence that an HOA rule has been violated.

Surveillance

We believe Homeowners have a right to understand community surveillance protocol and demand it is not weaponized against Homeowners.

Developer As Declarant

We believe Homeowners within an HOA community should have a clear understanding as to how long a Developer will remain as the Declarant before the community can be transferred over to the community's Homeowners.
We believe a Developer, when still in control of the HOA as its Declarant, should allow Homeowners a position on the HOA’s Board of Directors as follows: For a 3 Member Board - Less than 50% build out, 1 homeowner is voted in by the membership; at 50% build out, 2 homeowners are voted in by the membership. For a 5 Member Board - Less than 50% built out, 1 homeowner is voted in by the membership; at 50% build out, 2 homeowners are voted in by the membership; at 75% build out, 3 homeowners are voted in by the membership.
We believe a Developer MUST turn over the HOA to the Homeowners within a reasonable amount of time as specified in the HOA governing documents and not delay or stop the transfer process.

Our Mission

To enhance and protect the quality of life for South Carolina Homeowners who live in an HOA community.

Our Goal

As of 2022, South Carolina had over 7,000 HOA communities representing roughly 1.36 million people. Approximately 26.5% of South Carolina's population lives in HOA communities and the numbers continue to escalate.

While some HOAs can be fair and reasonable, there are many cases where living within an HOA community can become a nightmare.

Our goal is to unite South Carolina HOA Homeowner Members to lobby South Carolina Senators and Representatives to realize positive changes to our State's Non-Profit and HOA laws.

Currently South Carolina HOA Homeowner members aren't protected, and our only recourse is to engage legal representation to sue.

Engaging legal counsel as a group or individual is expensive and difficult to do.

We need fair laws and equal representation that protect South Carolina HOA members and not just protect Developers, Property Management Companies, Realtors and Lawyers.
